Terms of Use

These terms (the "Agreement") govern your use of the Posturato iPhone application and the posturato.app website (together, the "Service"). The Service is operated by the developer of Posturato ("we," "us"). For privacy inquiries, data deletion requests, or any legal notice, contact us at [email protected]. By using the Service you agree to this Agreement.

1. The Service

Posturato uses your iPhone's camera and on-device computer vision to estimate your posture from a selfie, give you a score, and suggest a daily routine of stretches and activations.

Posturato is a wellness and fitness product. It is not a medical device. It does not diagnose, treat, screen for, or prevent any disease, injury, or condition, including scoliosis, kyphosis, or chronic pain. If you have or suspect a medical condition, consult a qualified healthcare professional. Do not use Posturato as a substitute for medical care.

2. Eligibility

You must be at least 13 years old to use Posturato. If you are under the age of majority in your jurisdiction, your parent or legal guardian must agree to these terms on your behalf.

3. Your account

You create your account by signing in with Apple. You are responsible for keeping your Apple ID secure and for activity that happens under your account. Notify us at [email protected] if you suspect unauthorized access.

4. Subscription, free trial, and billing

Posturato offers an auto-renewing subscription with the following plans, sold through the App Store:

• Posturato Pro Weekly — $9.99 per week, after a 3-day free trial.
• Posturato Pro Yearly — $49.99 per year, after a 3-day free trial.

How auto-renewal works. Your subscription automatically renews at the end of each billing period at the price shown above (in your local currency at the rate Apple sets) until you cancel. Payment is charged to your Apple ID at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period.

How to cancel. Cancel anytime in Settings → [your Apple ID] → Subscriptions on your iPhone, or by visiting apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods; refunds are governed by Apple's policy at support.apple.com/HT204084.

Free trial. If you start a 3-day free trial, your subscription begins immediately at the end of the trial unless you cancel at least 24 hours before the trial ends. If you have used a free trial before, you may not be eligible for another.

Price changes. If we change subscription prices, we will notify you in advance and you will be able to accept the new price or cancel.

5. License to use the app

Subject to this Agreement, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use Posturato on any iOS device that you own or control, in accordance with Apple's Usage Rules in the App Store Terms of Service.

6. Acceptable use

• Don't reverse engineer, decompile, or attempt to extract the source code of the app.
• Don't resell, sublicense, rent, or commercially exploit the Service.
• Don't use the Service to harass, defame, or harm others, or to upload content that is unlawful, infringing, or someone else's private information.
• Don't bypass any technical measures we use to protect the Service.

7. Your content

Your scan photos stay on your device and we never receive them. The onboarding answers, scores, and completion records you generate are your data; you grant us a limited license to store and process them solely to provide the Service to you.

8. Intellectual property

Posturato, the wordmark, the logo, the user interface, the routine library, and all other materials we provide are owned by us or our licensors and are protected by intellectual property law. Nothing in this Agreement transfers any of those rights to you.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE FOR ANY PARTICULAR PURPOSE. POSTURE SCORES AND ROUTINES ARE INFORMATIONAL ESTIMATES, NOT MEDICAL ADVICE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend and hold us harmless from any claim, demand, or expense (including reasonable legal fees) arising from your misuse of the Service or your violation of this Agreement.

12. Termination

You can stop using Posturato at any time and delete your account from Settings → Delete account in the app. We can suspend or terminate your access if you materially breach this Agreement; we will give notice when that's practical.

13. Apple-specific terms (EULA)

This Agreement is between you and Posturato only, not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection or similar legislation. Apple and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you.

14. Governing law and disputes

This Agreement is governed by the laws of England and Wales, without regard to conflict-of-law rules. The courts located in London, England will have exclusive jurisdiction over any dispute arising out of or relating to this Agreement, except where mandatory consumer protection laws give you the right to bring proceedings in your country of residence.

15. Changes

We may update this Agreement from time to time. If a change is material we will notify you in the app or by email at least 14 days before it takes effect. Continuing to use the Service after the effective date constitutes acceptance of the new terms.
